Obtain a New Pharmacy (Facility) License

Retail/Community Pharmacy (Class A): license authorizes a pharmacy to dispense a drug or device to the public under a prescription drug order. Includes “closed door” pharmacy.

Nuclear Pharmacy (Class B) : pharmacy license authorizes a pharmacy to dispense a radioactive drug or device for administration to an ultimate user.

Institutional/Hospital/Ambulatory Surgery Center Pharmacy (Class C) : pharmacy license may be issued to a pharmacy located in:
(1)  An inpatient facility including a hospital, licensed under Chapter 241 or 577, Health and Safety Code;
(2)  a hospital maintained or operated by the state;
(3)  a hospice inpatient facility licensed under Chapter 142, Health and Safety Code; or
(4)  an ambulatory surgical center licensed under Chapter 243, Health and Safety Code.

Clinic Pharmacy (Class D): pharmacy license authorizes a pharmacy to dispense a limited type of drug or device under a prescription drug order. (e.g. Health Clinic or Planned Parenthood)

Non-Resident (Out of State) Pharmacy (Class E): pharmacy license may be issued to a pharmacy located in another state whose primary business is to:
(A)  dispense a prescription drug or device under a prescription drug order; and
(B)  deliver the drug or device to a patient, including a patient in this state, by United States mail, common carrier, or delivery service.

Freestanding Emergency Medical Care Center Pharmacy (Class F): A freestanding facility that is licensed by the Texas Department of State Health Services pursuant to Chapter 254, Health and Safety Code, to provide emergency care to patients.

Central Prescription Drug or Medication Order Processing Pharmacy (Class G): Any facility established for the primary purpose of processing prescription drug or medication drug orders shall be licensed as a Class G pharmacy under the Act. A Class G pharmacy shall not store bulk drugs, or dispense a prescription drug order.

Limited Prescription Delivery Pharmacy (Class H):  Any facility established for the primary purpose of limited prescription delivery by a Class A pharmacy shall be licensed as a Class H pharmacy under the Act. A Class H pharmacy shall not store bulk drugs or dispense a prescription drug order.
